Privacy Policy

General provisions
1.1. SIA Infantil (hereinafter referred to as the Company) respects the rights of all its clients (buyers) (hereinafter referred to as the Clients), including visitors to the website https://www.infantil.lv (hereinafter referred to as the Website), regarding confidentiality, and undertakes to protect their personal data and facilitate the exercise of their rights as data subjects.
1.2. The Privacy Policy regulates the fundamental principles and procedures for collecting, processing, and storing personal data of the Company Clients (including Website visitors).
1.3. By using the Company’s website, as well as ordering goods and providing your personal data to the Company, you agree to the terms of this Privacy Policy (except for actions related to data processing that require additional consent). It is considered that the Clients have read the Privacy Policy if they have ticked the text of this Policy when logging in to the Website/Clients’ system. The Privacy Policy is available on the Website for review at any time.
1.4. When processing your personal data, we follow the instructions of Regulation (EU) 2016/679 of 27 April 2016 of the European Parliament and of the Council on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, which repeals Directive 95/46/EC (hereinafter referred to as the Regulation), the Law on the Legal Protection of Personal Data of the Republic of Latvia (hereinafter referred to as the LLPPD), the Law on Electronic Communications of the Republic of Latvia (hereinafter referred to as the LEC) and others directly applicable legal acts regulating the protection of personal data, as well as data protection supervisory authorities (in Latvia – the State Data Protection Inspectorate).

What definitions do we use
2.1. Personal data means any information about a natural person whose identity has been or can be established (data subject); an identifiable natural person is a natural person who can be identified, directly or indirectly, primarily by reference to an identifier such as a first and last name, personal identification number, location data, online identifier, or by reference to one or more characteristics of that natural person’s physical, physiological, genetic, mental, economic, cultural or social identity.
2.2. Data Subject is an individual that is the Company’s Client (including Website Visitors), whose personal data is collected by the Company.
2.3. Data subject’s consent means any freely given, specific and unambiguous indication of the wishes of the data subject, on the basis of which he or she, by means of a statement or explicit statement, expresses his or her consent to the processing of personal data relating to him or her.
2.4. Data processing means any operation or set of operations performed by automated or non-automated means on personal data or on sets of personal data, such as collecting, recording, sorting, structuring, storing, adapting or modifying, searching, consulting, using, disclosing by transmission, dissemination or otherwise making available, as well as mapping or merging them with other data, restriction, erasure, or destruction.
2.5. Data processor means a natural or legal person, public authority, agency or other company that processes personal data on behalf of the data controller.
2.6. Data controller – SIA Infantil – a company established under the laws of the Republic of Latvia, registration number 40203072592, legal address: Jaunā iela 12, k-17, Piņķi, Babītes pag., Mārupes novads, Republic of Latvia. Data is collected and stored in the Register of Legal Entities.
2.7. A cookie is a small text file that is stored on a user’s computer or other end device when they visit a website.
2.8. Direct marketing is an activity aimed at offering goods or services to individuals by mail, telephone, or other direct means and (or) aimed at questioning individuals regarding their opinions about the goods and services offered to them.

What personal data do we collect
3.1. The Company collects and processes the following personal data provided by you when logging in and/or ordering services on the Website or in any other way: name, surname, e-mail address, phone number, data related to the provision of services, such as information about the service and its order, invoice numbers, invoicing, payment information, information about consent or disagreement regarding the processing of personal data for direct marketing purposes, passwords, any other data that you additionally provide yourself when logging in to the system and (or) ordering services, managing them.
3.2. Your personal data specified in Clause 3.1 is stored for the period of cooperation between you and the Company (service period) and for 10 (ten) years after the expiration of this period.
3.3. The Company collects and processes the following personal data provided by you indirectly when logging in and/or ordering services on the Website, i.e. this data is automatically collected from the computers and/or mobile devices you use after you have logged in to the Website: IP addresses and connection times, the user’s browser and its version, the websites visited before accessing our Website, service usage data, such as data collected through cookies and similar technologies related to web browsing, etc.
3.4. Your personal data specified in Clause 3.3 is stored for the period of cooperation between you and the Company (service period) and, depending on the data, up to one year after the expiration of this period. This data may be retained for a longer period if there are other legal bases for such retention period.

For what purposes do we process your personal data
4.1. The Company processes the above-mentioned personal data for the following purposes: to process and administer the purchase (order) of services, to identify the Company’s Clients in the Company’s information systems when registering and logging in to their account on the Website, for accounting purposes, to contact you regarding the performance of contractual obligations, as well as for direct marketing purposes (only with the prior consent of the data subjects).

How do we process your personal data
5.1. We guarantee that your personal data will be: processed on the basis of lawfulness, impartiality, and transparency; collected for specific and legitimate purposes and the data will not be further processed in a manner incompatible with the specified purposes; adequate, relevant and necessary only for the purposes for which they are processed (the principle of data reduction applies); accurate and, if necessary, updated (the principle of accuracy applies); processed in such a way that, when applying appropriate organisational and technical measures, appropriate protection of personal data is ensured, including protection against data processing without authorisation or against unlawful processing of data and their unintentional loss or destruction (the principles of integrity and confidentiality apply).

What rights do data subjects have?
6.1. You have the following rights of data subjects, which we will exercise after receiving your request (by e-mail info@infantil.lv; by post to Jaunā iela 12, k-17, Piņķi, Babītes pag., Mārupes novads, LV-2107) and after you have duly confirmed your identity: the right to access the processed data; the right to request the correction or clarification of incorrect or inaccurate personal data; the right to request the erasure of the personal data being processed, if: (a) personal data is no longer necessary in relation to the purposes for which it was collected or otherwise processed, (b) you withdraw your consent and in the absence of other legal grounds for the processing of your personal data, (c) the personal data has been processed unlawfully, (d) on other grounds set out in the Regulation; the right to restrict the processing of personal data, the right to receive personal data related to you that you have provided in a systematic, commonly used and machine-readable format and the right to object to the processing of personal data (e.g. for direct marketing purposes, etc.).
6.2. It should be noted that if you believe that your rights as a data subject have been violated, you can file a complaint with the State Data Protection Inspectorate. How do we process personal data for direct marketing purposes
7.1. The Company will send you newsletters by e-mail and/or make inquiries about the quality of current services only with your prior consent and on the basis of the provisions of the LEC, the LLPPD and the Regulation.
7.2. Your personal data processed for direct marketing purposes includes your first name, last name and email address.
7.3. Your personal data collected and processed for direct marketing purposes is stored until you withdraw your consent to receive direct marketing communications.

Who do we share your personal data with
8.1. Access to your personal data is granted to the company’s employees only if it is necessary for the performance of their official duties, and only if the employee undertakes to comply with the confidentiality requirement.
8.2. The Company may transfer your personal data: to data processors who provide services to the Company and process your personal data on behalf of and in the interests of the Company or your benefit, or to law enforcement authorities, if there is a legal basis for this,
8.3. We only engage data processors who can ensure the implementation of appropriate technical or organisational measures in such a way that the data processing complies with the requirements of the Regulation and that your rights as data subjects are protected.
8.4. It should be noted that the above-mentioned data processors are only entitled to process your personal data in accordance with our instructions.
8.5. The data processor shall engage another data processor only with the prior explicit or general written consent of the Company (data controller).
8.6. Your personal data may also be provided in response to official requests from public authorities and the court, but only after verifying the legitimacy of these requests.
